When can a Rental Company be Held Liable?

Typically, the at-fault driver in the accident is the one held liable for damages, but there are instances where a rental car company could be held accountable for your injuries.

Unless you can prove the rental company was negligent in some way, any lawsuit that is brought against them for an auto accident will be thrown out of court. This is due to the Graves Amendment, which declares that rental car companies cannot be held liable for the negligence of a customer driving one of their cars.

The amendment doesn’t necessarily let rental companies off the hook if their negligence contributed to the accident. A rental company can be held liable in numerous ways. For instance, the rental car company rents a vehicle to a person they know, or should have known, was an unsafe driver.

The rental company can also be held liable for negligence in the maintenance of their vehicles. If the rental car company failed to properly maintain a vehicle’s braking system, and the faulty system failing led to the accident, both drivers could have a case against the company.

Rental Car Driver at Fault

It’s best to keep in mind that, as a renter, you are responsible for any damages or loss to the rental vehicle. There are three primary sources for potential insurance coverage that include the rental car company, your personal car insurance and the credit card you used to pay for the rental. 

Depending on the type of coverage you purchased from the rental company, the rental agency may only cover so much. For instance, if you bought collision damage coverage, it will just cover damage to the vehicle and not property damage and bodily injury.

If you have personal car insurance, most policies will cover what the rental company’s liability coverage offers such as comprehensive and collision coverage. If you rented a vehicle using a major credit card, you might automatically have car rental insurance.

Depending on the terms of your credit card agreement, the company may cover damages to the rental vehicle, but they typically don’t provide liability coverage.

What does Rental Car Insurance Cover?

When you purchase a rental car, the company will typically offer different types of insurance coverage. There are typically four types of coverage options offered when you rent a car. These options include the following:

  • Loss-damage waiver: Also known as collision damage, this type of renters insurance shifts the financial responsibility from the renter and to the rental company. It covers damages to the vehicle if the vehicle is stolen and loss of use charges such as repair and towing cost.
  • Liability coverage: If you are the at-fault driver in an accident while driving the rental car, this coverage will cover injuries to other drivers and property damage.
  • Personal accident insurance: This type of coverage covers medical costs for you and a passenger following an accident.
  • Personal effects coverage: Personal effects coverage covers theft of what is kept in the rental car. Coverage is usually up to a set dollar amount.
